The cry of rape or abuse is a familiar cry when a relationship goes sour or when a woman has second thoughts after a night of sex or near intimacy. While there are certainly legitimate claims of rape and attempted rape in the world, from the defendants perspective there are good reasons to view each claim with skepticism. Relationship rapes and date rapes are closely related and the techniques to defend each are similar. The reasons for the accusations vary as do the situation, the character and personality of the alleged victim. In the system you see questionable accusations when dating or love relationships go sour and the woman is being rejected or being thrown aside for another woman. Sometimes in more casual dating the woman makes an accusation after having too much alcohol and engaging in sex. The morning after they realize what they have done and an accusation follows to protect their pride, cover their embarrassment, or justify a situation to their boyfriend or significant other. Sometimes in younger women the issue of sex is still very delicate and the accusation comes after giving in and realizing afterwards what they have done does not sit well with their present psyche. Again, many times alcohol is a factor. Sometimes the mental stability of the alleged victim is a major factor in making an accusation. All experienced rape defense lawyers have seen the young man who falls for a beautiful but unstable young woman and ends up getting accused when they break up or go farther than the womans mental state will allow. And, quite frankly, men are often too driven by their sexual desires to be careful in their judgments about who they attempt to bed. Men view sex entirely different than women for the most part. Men are very capable of enjoying sex and not thinking anything about it afterwards except for how much fun they had. Women may claim that is how they feel but the facts of these accusations show they have a much harder time accepting it as such a meaningless act of pleasure. It is in these instances that false accusations arise. Also, often times no means no to a woman. A man can easily interpret no as yes. He thinks she is just trying to show that she is not easy. Unfortunately, the trend in most states is that when a woman says no it means that consent to proceed has been withdrawn, even in the throes of great passion. In a rape defense it is important for the lawyer to understand all of the circumstances of the relationship or the situation. A detailed minute by minute account is necessary to understand whether the rules have been broken. Many times if there is simply a misreading of signals, the benefit of the doubt will be given to the defendant. Most jurors have been in multiple sexual and intimate situations and they can understand mixed signals. The more you can show that the woman gave off all of the signals of a willing participant, the better your chances of success. The witnesses to her earlier drinking and provocative conduct can provide good evidence that the defendant thought she was desirous of consensual sex. While most states rape shield laws go far in protecting the history of the alleged victim, your lawyer should find out as much as they can about the alleged victims history. Due Process requires you to be able to defend yourself and a good lawyer can usually find information that is admissible that sheds light on her character. The defendants character for not being sexually aggressive can be important. It is admissible evidence to show that you are not sexually aggressive. Prior girlfriends, female friends and co-workers, and friendly ex-spouses can be a good source for this evidence. Your attorney must be prepared to contest the medical evidence if the alleged victim went to a hospital or a sexual assault response team. The current trend is for these medical personnel to testify that the alleged victims had physical injury to their vaginal area. What is usually found are microscopic abrasions that are a result of the friction of intercourse. Sometimes the prosecutions medical personnel try to say these micro-abrasions are inconsistent with consensual sex. The research shows that micro-abrasions dont mean anything negative. They are as consistent with consensual sex as well as anything else. Your lawyer must be prepared to cross-examine these alleged experts aggressively. Your lawyer should also have a counter-expert ready to testify to the opposite of the prosecutions expert. Date rape accusations arent just limited to younger people. It happens throughout the age spectrum where single men go out with women of questionable stability. If the accusation comes out of a relationship breakup, look carefully at the mental history of the alleged victim. Many times young men fall in love with very defective young women. A symptom of certain personality disorders seen in young women are the inability to handle rejection. A person they once idealized quickly becomes their archenemy and subject to false accusations of rape. If your jurisdiction allows, your lawyer should get a psychological evaluation of the alleged victim. If your jurisdiction doesnt allow it, you should investigate her history thoroughly. With a psychologist to guide your efforts, you will probably find evidence to support your theory. As part of your investigation, look for prior instances of credibility problems on the part of the alleged victim. Check her job history and try to find her former boyfriends. Chances are you will find a history of lying and deception. In any rape or attempted rape accusation you must find the motive of the alleged victim to lie. These cases of false accusations can be defended successfully, but you must find the motive. It is the key to the jury understanding why the young lady would go so far as to make such a serious false accusation of rape against you. William F. In a presentation I heard over 15 years ago, one of his phrases still reverberates: The banquet is laid, though nobody comes.* When I recently asked about him about it, he said, I use it to refer to the banquet nature/God sets before us everyday. Yet, as he points out, we are often too stuck in whatever is in front of us to step back, look around, and see the bounty of beauty before us. A banquet often involves a buffet a display of yummy food from which we choose. We are given the opportunity to not only select known favorites, but to sample items we might not normally pick. If we try the new fare, we may come back for seconds and add it to our list of delectable delights. When women tell me they havent gathered the gumption to start dating even though they want to, I think of Dewitts line: The banquet is laid, though nobody comes. The banquet is a plethora of interesting men to be met, and among them, we hope a delectable delight or two. Ideally one who will become our all-time favorite and last a lifetime. Yet many are afraid to start, settling instead on their current lives as fulfilling as they may be even though they long for a mate to share their lives and add a dimension they feel is missing. Of course, Im not suggesting that to be single is depriving you of the banquet of life. We are using the metaphor here specific to dating. Dewitt uses the phrase in the context of enjoying the beauty of nature. Im using it to encourage those who are a trifle repadacious about tapping the terrific treats of dating. If youve decided to get back into the dating scene but havent yet made the next move, think of the banquet that awaits you. Just as at a banquet, not every dish will be to your liking. Dating allows you to taste dishes you might not have tried before. Dont turn down an invitation from someone who doesnt meet 100% of your criteria. If hes 85-90% what youre looking for, at least have coffee. Even if you arent drawn to him or visa versa you can now say, Ive tried X and it isnt to my taste. But if you dont even allow yourself to try something new, how will you know? But know that perhaps one of these tastes will result in your establishing a new preference something you may not have thought youd like. I thought Id only want someone with a certain type of job. But Ive become fond of someone who works in an industry that wouldnt have been on my desired list. So get out your plate and be willing to go through the banquet line with an attitude of openness and inquisitiveness. Barriers to Healthy Diets — Removing them is not as hard as you think

By Michael Smith, MD Barriers to healthy diets are placed into four broad categories: External Barriers Psychological Barriers Physical Barriers Dieting BarriersThis article examines only the most difficult barriers in each category. Let’s remove the barriers to healthy diets…but first, “What is a Healthy Diet?” What is a Healthy Diet? A healthy diet provides the recommended daily allowance for vitamins, minerals, protein, carbohydrates, and fat. Any diet that fails to meet the minimum daily allowance for any nutrient is unhealthy. Of course, providing the daily allowance for all nutrients is next to impossible given the poor nutritional value of today’s diets. We eat on average 1.5 meals a day (not even close to the suggested 5-6 meals). The one meal we manage to eat is usually late in the evening, high in calories, high in fat, and is missing Group I Foods (fresh vegetables and fruit). The majority of young men between the ages of 20-25 eat only 2 servings of fruit and 1 serving of fresh vegetables throughout the week! The next generation is nutritionally starved. A healthy diet is quite simple and easy to follow. Here are the steps to eating a healthy diet: Eat 5-6 meals a day. Every meal should have a serving of lean protein, complex carbohydrate, and unlimited amounts of Group I Foods. Eat approximately 40-50% protein, 30-40% complex carbohydrates, and 30% fat everyday. Limit sugars, saturated fats, and trans-fatty-acids. Maintain a slightly negative energy balance or perfectly balance it. How do you accomplish this? Read the next few steps! Calculate your energy output everyday. Energy output is the Resting Metabolic Rate plus the number of calories burned through physical activity. Subtract your energy output from your energy input — the number of calories you eat a day. The result is the remaining total energy and it determines your energy balance. If the result is a positive number, you have a Positive Energy Balance. Simply, cut back on the amount you eat. If the result is negative, you have a Negative Energy Balance. Increase the amount you eat. Make adjustments to energy input (the number of calories you eat a day) so that you’ll remain with a slightly negative energy balance. Some weight loss experts advocate a strong negative energy balance at baseline. In theory, this makes sense but in practice it’s associated with weight regain. I believe that energy should be balanced or slightly negative at baseline. The closer to a balanced energy state, the better the chance for avoiding weight regain and maintaining your ideal weight for a longer period of time. Do not cut back, slow down, or stop exercising. If adjustments need to be made, it’s better to make dietary changes than to make changes to your exercise plan.A healthy diet is simple to follow. Eat fewer calories, exercise, and make dietary adjustments as needed. No pills, supplements, acupuncture, magnets, or magic minerals are needed. Just a calculator. Removing External Barriers to Healthy Diets Two difficult external barriers are peer pressure and time. Our friends and family influence our lives more than we like to admit. They affect our decisions, choices, moods, behavior, and weight. During medical school, I worked in a weight loss clinic to make some money. I will never forget the level of influence a spouse or friend could have on a patient. Several times, I saw first hand someone, other than the patient, make the dieting decisions. At this level of influence, our peer groups can make a big impact on eating a healthy diet. Just keep this influence thing in mind. OR, should I say, “Keep it in mind only if you have TIME.” Time is another rarely acknowledged external barrier to healthy diets. We live in world that seems to lose time. The normal 24 hour day feels more like 15 hours. All we do is rush from one event or appointment to the next. Eating a healthy diet is next to impossible. Please, slow down. Who knows, by slowing down we might actually pay attention to the important things in our lives. I find that the more I rush the less I get done. And what I do finish, really isn’t all that important. Be serious about eating a healthy diet and slow down. Removing Dieting Barriers to Healthy Diets About two to three decades ago, while watching repeats on TV, Americans changed their diets and started eating lots of fat and processed foods. We have suffered ever since. Eating lots of fat created a macronutrient imbalance and has clogged our arteries. Then we fell in love with processed foods. This love affair drained all of the vitamins and minerals from our bodies and resulted in a micronutrient deficiency. Until we restore things to the pre-TV Dinner diet, we will continue to suffer heart attacks and weight gain. It’s really crazy…we stuff ourselves with heavy fat and then starve for vitamins and minerals. Removing Physical Barriers to Healthy Diets Physically, our lack of exercise is the greatest barrier to healthy diets. Start exercising! Walk. Jog. Swim. Lift weights. Sweat. Move. Breath. Live. Removing Psychological Barriers to Healthy Diets The mind can be tough to control, especially when it comes to hunger. But what can help is changing your food perspective. Food Cravings: Use EFT to Learn Patience

By Kathryn Martyn, M.NLP Food Cravings: How to Practice Patience During holidays and parties you may try to “plan ahead” so you can avoid some of the rush. Last year at Christmas I realized I had to take three major dishes for Christmas Eve dinner and it suddenly dawned on me that I’d have to bake the cake the night ahead. Baking a cake then waiting to eat it is not my favorite thing at all. I’ve always had a difficult time in making a cake a day ahead, in fact I tend to avoid receipes that say it needs to sit eight hours. (Whenever you catch yourself saying the word “always” that’s a hint something to use EFT on is coming to mind and notice I said I always have a difficult time with this? That’s when to use EFT). My past behavior has been to want to eat the cake as soon as it’s finished, so if it must wait for a day, it’s torture. I also prefer making huge three and four layer cakes that take up the entire refrigerator causing me to see the cake and nothing but the cake every time I open the refrigerator door. Practicing Patience in Eating Patience can be practiced all day every day. It is necessary when dealing with strangers, family, and most of all yourself. Just because you usually give in to your immediate desires for food doesn’t mean you must do so. Maybe you are trying to avoid feeling deprived but practicing and learning to exercise some patience may be of good use. If I bake a lovely cake and see it in the refrigerator, it beckons to me. Knowing I cannot take a slice without ruining the presentation doesn’t seem to help me avoid the siren call. I could be sitting, minding my own business, when I suddenly snap my head upright, as if I’ve heard a ghost, “Come and get a piece of cake,” it calls to me. “I’m waiting,” it cries. “Stupid cake, I think.” Leftover cake isn’t such a big problem because I plan ahead to have at least one piece, sometimes two every day as long as it lasts. That’s another reason I prefer baking to take it somewhere rather than just making it for home. Rather than trying to analyze why I have this strange desire to eat cake, I’m just going to tackle it head-on with some EFT. I may also use the Swish Technique (taught in the Ending Emotional Eating workshop, Session 4). If you’ve had similar struggles, try these suggested EFT phrases, or devise some for your situation. (EFT is easy to learn and use–see my site for worksheets and instructions specific to weight loss or visit http://www.emofree.com for general information on learning EFT). ===== EFT for Patience in Eating While tapping the P.R. (psychological reversal) point say, “Even though I want to eat the cake, except I’m not supposed to because it’s for tomorrow’s dinner party, I deeply and completely accept myself.” Repeat that statement three times and say it like you mean it. Then tap the rest of the face and body points, using a short reminder such as, “eat cake.” The entire time think about that cake and how much you want it and how delicious it would be. The control issue is what is being addressed. The desire or compulsion to have something that seems beyond a rational desire, that is what you are working to reduce.
